SRINAGAR (KIMS) — The Jammu and Kashmir Anti-Corruption Bureau (ACB) on Monday produced a chargesheet against 10 accused persons, including seven officers and officials of the Srinagar Municipal Corporation (SMC) and three private individuals, in a case involving alleged abuse of official position, criminal conspiracy and conferring undue benefit on private beneficiaries.
According to the ACB, the chargesheet was filed before the Court of Special Judge, Anti-Corruption, Srinagar, in connection with FIR No. 06/2023 registered at Police Station ACB Srinagar.
The case was registered following allegations that officers and officials of Ward No. 28, Batamaloo, had allegedly abused their official positions and entered into a criminal conspiracy with a private beneficiary, Reyaz Ahmad Dar, son of Abdul Rahim Dar, a resident of Tengpora, Batamaloo.
The ACB alleged that the accused officials facilitated and allowed Dar to raise illegal and unauthorised construction near Tiny Hearts School in Tengpora, Batamaloo.
According to the anti-graft agency, the investigation, based on oral and documentary evidence, substantiated the allegations against the accused government officials and private beneficiaries and established the alleged conspiracy between the public servants and the beneficiary.
The accused have been charged under Section 5(1)(d) read with Section 5(2) of the Jammu and Kashmir Prevention of Corruption Act, Samvat 2006, Section 120-B of the Ranbir Penal Code (RPC), Section 4-A of the Requisitioning and Development Act, and Section 9-A read with Section 20 of the Evacuees (Administration of Property) Act, 1949.
The ACB said the requisite sanction for prosecution of the public servants was obtained from the government before the chargesheet was presented before the court for judicial determination. — (KIMS)
